3. Environmental protection act

The Environmental Protection Act (1990) requires that the local authority take reasonable steps to investigate and, if appropriate, take formal action. Through serving an Abatement Notice on the person responsible should a statutory nuisance be justified.

Typical complaints of this type are:

  • smoke and ash from garden bonfires
  • domestic or industrial noise
  • dust from building or demolition activity
  • cooking smells from restaurants
