Amount of Education Penalty Notice penalties
The amount of the penalty is dependent on whether it is the first or second penalty notice issued to the parent in respect of the same child in a rolling three year period commencing with the date of issue of the first penalty notice.
First penalty notice in rolling three year period
Where an Education Penalty Notice is the first penalty notice issued to a parent in respect of a particular child in a three year period ending with the date of its issue, payment is at the rate of £80 if paid within twenty-one days. Payment after this time, but within twenty-eight days of receipt of the notice is at the rate of £160.
Second penalty notice in rolling three year period
Where an Education Penalty Notice is the second penalty notice issued to a parent in respect of a particular child in a three year period ending with the date of its issue, the amount of the penalty is £160 if paid within twenty-eight days.
The following Education Penalty Notices do not count towards these limits:
- Those which have been withdrawn by the LA.
- Those which resulted in a prosecution due to non-payment in which the recipient was found not guilty by the court.
- Those issued for offences taking place prior to 19/8/2024.
